TERMS AND CONDITIONS OF SALE AND SITE USE
ONE STOP MUSIC (PTY) LTD (TRADING AS ONE STOP MUSIC / MARSHALL MUSIC)
1. INTRODUCTION
The OneStopMusic online shop can be accessed at onestopmusic.co.za, related mobile sites, and applications (“the Site”). The Site enables buyers to shop for items including musical instruments, sound equipment, studio processing gear, software, and accessories by selected local and international brands (“the Products”) online and have them delivered door-to-door or via courier services within South Africa, or select areas globally.
All visitors to the Site (“Users” or “you”) will be able to see the Products on offer, but only those who have registered for an account on OneStopMusic (“Account Holders” or “you”) are able to purchase.
Legally Binding Contract
All Users and Account Holders, including those that buy from the Site (“Buyers”), are strictly bound by these terms and conditions (“Ts & Cs”). By accessing, registering an account, browsing, or utilizing the Site in any capacity, you recognize that you have read, understood, accepted, and explicitly agreed to be bound by these T&Cs. Should there be any clause in these T&Cs that you do not fully understand, the onus is strictly on you to request OneStopMusic to explain the relevant clause to you before you accept the T&Cs or finalize a purchase.
Contractual Parties
The Site is owned and operated by OneStopMusic, a commercial division owned by One Stop Music (Pty) Ltd (Registration Number: 99/15016/07), a private company duly incorporated in accordance with the company laws of the Republic of South Africa (hereinafter referred to as "OneStopMusic", "the Company", "we", or "us").
Products and Availability
Please note that the physical stock of all items on offer is limited. OneStopMusic will make all reasonable attempts to ensure that promotional offers are brought to an end when inventory runs out. If it occurs that OneStopMusic is unable to fulfill any electronic order because stock is sold out, discontinued, or allocated elsewhere due to inventory lag, OneStopMusic will notify you via email and you will be entitled to a full reimbursement for the exact Rand value you have paid for such product. This is described in more detail in OneStopMusic’s Delivery and Returns Policy, which is explicitly incorporated into these T&Cs by reference.
2. BUYING PRODUCTS & CONTRACT FORMATION
- The Site allows you, the User, to place electronic orders (“Order”) for one or more Products on offer as long as such Products are physically available in inventory and not sold out.
- The Formation of a Binding Sale: The display of Products, Regular Retail Prices (RRP), or Discount Prices on the Site does not constitute a legally binding contractual offer by OneStopMusic. Instead, it serves merely as an "invitation to do business" (an advertisement). A purchasing contract (“Sale”) between you and OneStopMusic does not automatically come into effect when you complete the online checkout, when you submit the order form, or when your payment is authorized.
- The Trigger Point: A legally binding contract of Sale is only concluded, and OneStopMusic is only bound to supply the ordered items, at the moment the physical Product is successfully scanned and dispatched from our logistics facility and an explicit "Order Shipped/Dispatched" confirmation tracking email is systematically sent to you.
- Products on OneStopMusic cannot be reserved to be bought at a later stage, and placing an item in your shopping cart without completing the order does not amount to a Sale or an Order. OneStopMusic reserves the absolute right to remove any item from your cart before the Sale actually takes place if the product goes out of stock or undergoes a price correction.
- OneStopMusic cannot be held responsible or legally liable if an item has become unavailable or has reverted to its correct pricing by the time you attempt to complete a purchase at a later stage. The electronic tax invoice for your purchase will be available online in the “My Account” section on the Site, and a copy will be included in your parcel.
3. CANCELLING AND ENDING ORDERS
OneStopMusic reserves the absolute right, at its sole discretion, to refuse the processing of payment for any Order and/or to cancel any purchase completely or partially, at any time prior to the physical dispatch of the items, upon giving notice to you.
In terms of South African e-commerce regulations, OneStopMusic’s sole liability for cancelling a transaction prior to dispatch will be to reimburse you the exact Rand value paid for the cancelled Order. You have the right to return items successfully purchased in accordance with the timelines and rules detailed in Section 9 below and the Site's Delivery and Returns Policy.
4. FRAUD prevention and mitigation
OneStopMusic reserves the right, in the interest of preventing electronic payment fraud, cybercrime, and identity theft, to refuse the processing of payment for any order and/or to cancel any purchase, partially or completely.
OneStopMusic may request official documentation (such as proof of identification or card ownership) to complete the necessary fraud prevention checks and reserves the right to cancel any transaction where the necessary documentation is not provided in a timely manner. In the event of a fraudulent purchase being placed on the Site, cardholders will be advised to initiate an official chargeback via their banking institution in order to be refunded. OneStopMusic does not process manual refunds for orders flagged or suspected of fraud, nor do we provide third-party data or order details relating to orders suspected of fraud, except to authorized law enforcement agencies.
5. PRODUCT PRICING & THE "ERRONEOUS PRICE" SAFETY NET
The price of each product is given in the product information.
The Regular Retail Price
- The Regular Retail Price (“RRP”) is the standard price that OneStopMusic charges for the product. The RRP is determined by considering the suppliers’ wholesale cost, currency fluctuations, market conditions, and the prices being offered by other retailers.
- When a product is not on sale, on Outlet, or included in a discount promotion, the RRP is the price you will pay when you purchase the product (“Purchase Price”).
- Please note that RRPs can change over time based on supplier increases, logistical costs, and manufacturer updates. The RRPs applicable at the time a product is introduced may differ from the RRP at the time of your purchase.
The Discount Price
- When OneStopMusic is conducting a sale, clearing items in Outlet, or running a promotional campaign on specific products on the Site, the discount price is shown on the product page alongside the Regular Retail Price (“RRP”). The discount price will generally be visually highlighted, and the regular RRP will be displayed alongside it with a strike-through.
- When a discount price is accurately displayed, it is the price you will pay when you add the product to your cart and conclude the Sale by dispatch during the active promotional window.
Pricing Accuracy & The "Snatching a Bargain" Doctrine
- Every reasonable administrative effort will be made to ensure that the pricing displayed on OneStopMusic is correct at the time of your checkout. However, system glitches, technical database synchronization errors, or typographical omissions may occur.
- Statutory Pricing Safety Net: In terms of Section 23(1)(b) of the Consumer Protection Act 68 of 2008 ("CPA"), online pricing transactions are explicitly exempted from the rigid price-matching rules that govern brick-and-mortar retail stores. Instead, online transactions are governed by Section 43 of the Electronic Communications and Transactions Act 25 of 2002 ("ECT Act") and South African Common Law.
- If a Product is offered at an erroneous price due to an inadvertent technical glitch or obvious human typo (including pricing anomalies where the mistake represents a massive, manifest deviation from realistic market retail values—such as a 90% or greater discount error), OneStopMusic is strictly not obliged to supply the Product at the incorrect price.
- In such instances, no mutual consensus (animus contrahendi) exists between the parties. OneStopMusic will cancel the order, provide written notice to the user, and issue an immediate refund. The customer may not legally exploit the technical glitch or "snatch at a bargain." OneStopMusic’s sole liability is limited to returning the exact payment already received.
6. DELIVERY FEES
- For orders of R1000.00 or more, in main delivery centres within South Africa, OneStopMusic delivers door-to-door free of charge.
- For orders under R1000, in main delivery centres within South Africa, OneStopMusic charges a R200.00 fee to deliver door-to-door.
- For orders of R3000.00 or more, if you reside outside of a main delivery centre in South Africa, door-to-door delivery is free of charge.
- For orders under R3000.00, if you reside outside of a main delivery centre in South Africa, door-to-door delivery is R400.00.
- OneStopMusic does not deliver to PO Boxes.
- OneStopMusic will deliver door-to-door to selected areas outside South Africa, subject to a delivery/freight cost being established (excluding customs and import duties) and mutually agreed upon. Delivery to these selected areas will take within 21 working days. Please see Section 10 for specific terms and conditions for delivery outside of South Africa.
- Every reasonable effort is taken to ensure that the delivery costs displayed on the site are correct at the time of your purchase. However, if a delivery fee is incorrectly displayed due to a technical error, OneStopMusic will not be obliged to deliver products at an incorrect delivery fee. OneStopMusic will only be liable to return payment already made by you in the case you choose to cancel the sale once you have been made aware of the correct delivery fee.
7. MAKING A PAYMENT
Paying by Credit or Debit Card
- OneStopMusic accepts payments made by valid Visa and MasterCard credit cards, chipped debit cards activated for online purchases, and Electronic Funds Transfer (“EFT”) via authorized instantaneous payment gateways.
- When you place an order, the transaction details are securely presented to your banking institution for immediate authorization of the payment amount.
- If authorization is not obtained, the order is cancelled automatically. You warrant and guarantee that you are fully authorized to use the credit/debit card presented for the payment of your order and that there are sufficient funds available to cover the full costs of the transaction.
Paying by EFT
- When selecting to pay by manual EFT, you have exactly 24 hours post placing your order to make the payment.
- When making your payment, you must utilize your exact electronic order number as your primary reference. OneStopMusic cannot be held liable for allocation delays or stock-outs caused by an incorrect reference number.
- The order will only be processed once the funds actively reflect in OneStopMusic’s bank account. Depending on inter-banking clearance schedules, this can take up to 3 business days. If the funds do not reflect within 72 hours, OneStopMusic reserves the right to cancel the order and return the inventory to stock.
8. PLACE OF DELIVERY & LOGISTICS
- OneStopMusic delivers within business hours (Monday to Friday, excluding public holidays) in the Republic of South Africa, as well as selected cross-border territories.
- As the buyer, you are responsible for providing an accurate delivery address, postal code, and functional contact numbers.
- In the case of door-to-door delivery, your parcel will be delivered to the physical address specified during the checkout process. If nobody is present at the address at the time of delivery, our courier will on the second attempt use the mobile phone number provided and/or leave an attempted delivery note.
- The courier will attempt delivery twice. If both attempts fail, the parcel will be returned to OneStopMusic’s central hub, and it will be your responsibility to contact us via email at info@onestopmusic.co.za to arrange re-delivery at your own cost.
- If you do not contact us within 5 working days of the parcel being returned to our hub, OneStopMusic reserves the right to cancel the purchase and reimburse you the Rand value paid for the product, minus the initial and return transport costs incurred by the Company.
Delivery Completion and Verification
- A delivery is considered completed as soon as the parcel is signed for and accepted by an individual at your specified delivery address, as verified by the courier’s electronic tracking system.
- It is your statutory responsibility as the buyer to inspect the parcel on arrival. You or your designated receiver have the right to refuse the package if it appears to have been opened, tampered with, or structurally damaged in transit. Any justifiable shortages or transit damage complaints must be reported to our call centre within 24 hours of delivery.
Lost Parcels
If our tracking system provides no indication of the parcel's whereabouts, you must report the delay to our customer support team immediately. If the parcel is declared officially lost by the logistics provider, OneStopMusic will notify you and either ship a replacement product (subject to stock availability) or issue a full refund covering the purchase price and the associated delivery fees.
9. WARRANTY, RETURNS, & THE STATUTORY COOLING-OFF RIGHT
Statutory 7-Day Cooling-Off Right (ECT Act Section 44)
- In accordance with Section 44 of the ECT Act, a natural person who purchases goods online is entitled to cancel an electronic transaction without reason or penalty within 7 (seven) days of receiving the physical Goods.
- Conditions of Return: To exercise this cooling-off right, the items must be returned to OneStopMusic completely unopened, unused, and in their pristine, original packaging.
- Transport Costs: In terms of Section 44(2) of the ECT Act, you are solely responsible for the direct cost of courier transport required to return the goods to our facility.
- Exclusions: This cooling-off right explicitly excludes custom-ordered or imported items, unsealed software or software licenses, and any purchases made by a juristic person (companies or close corporations).
Defective Goods (CPA Sections 55 and 56)
If you are dissatisfied with your purchase due to a manufacturing defect or material fault, you are entitled to the protections outlined in Section 56 of the CPA. You may return the item within 6 months of delivery. If the item is found to be legitimately defective following examination by an authorized technician, you are entitled to have the product repaired, replaced, or refunded in full. This right does not apply to regular wear-and-tear, clear negligence, or abuse. Cross-border returns from outside South Africa are explicitly excluded from free return logistics.
10. TERMS AND CONDITIONS FOR INTERNATIONAL DELIVERIES
- OneStopMusic delivers internationally to selected African territories surrounding South Africa.
- Estimated international delivery time is 21 working days and is strictly subject to regional customs clearance, border protocols, and inter-banking clearance.
- Cross-border delivery costs are subject to a specific freight quote being established and mutually agreed upon prior to dispatch.
- Import Taxes and Customs Duties: All items imported into a foreign country are subject to international importing fees, customs clearance fees, local VAT, and duties. These costs are not covered by OneStopMusic. The recipient is solely responsible for clearing these costs with their local revenue service.
- Refusal to pay customs duties will result in the parcel being abandoned or destroyed by border authorities. In such instances, no refund or reimbursement will be issued by OneStopMusic.
- In accordance with the DAP (Delivered at Place) Incoterm, OneStopMusic clears the goods for export and bears the risks/costs of transport to the named destination country. The buyer is responsible for importing processes and duty costs. Returns are not allowed on products shipped outside of South Africa, unless the item arrived damaged and definitive proof is provided within 24 hours of arrival.
11. SALES RECORDS
Complete records of each electronic transaction between you and OneStopMusic are kept on the Site database for a period of 12 months following the purchase date. During this timeframe, you will be able to view and print these records via your account portal. Following this 12-month period, the responsibility of maintaining records of the purchase falls strictly on the buyer.
12. DISCOUNT VOUCHERS, COUPONS, AND GIFT CARDS
OneStopMusic may release digital or printed promotional discount vouchers/coupons from time to time.
Promotional Vouchers
- Promotional vouchers are issued at OneStopMusic’s absolute discretion. Users do not have an inherent right to vouchers and cannot earn them as cash equivalents. Vouchers are subject to strict expiry dates that cannot be extended.
- A promotional voucher can only be applied to a purchase when the transaction meets the specific terms outlined on the voucher (e.g., minimum spend thresholds). Only one promotional voucher can be used per shopping cart transaction. Vouchers are non-transferable and cannot be exchanged for cash.
- If you return an item bought with a promotional voucher, OneStopMusic will recalculate the remaining value of the purchase. If the remaining items no longer meet the original terms of the voucher, OneStopMusic reserves the right to deduct the value of the voucher from your refund or account credit.
- Promotional vouchers cannot be used to buy gift vouchers, cannot be transferred to a third party, and cannot be used in conjunction with items already heavily discounted in Outlet or on special clearance offers.
Gift Vouchers
- Electronic gift vouchers can be purchased through standard payment methods on the Site. Gift vouchers cannot be used to purchase further gift vouchers.
- The balance of a gift voucher does not accrue interest and possesses zero cash value. Gift vouchers are non-refundable for cash once purchased.
- If a gift voucher is used to purchase a cart that is of a higher value than the voucher, the residual amount must be paid via standard card or EFT payment.
13. WEBSITE SECURITY & CYBERCRIME PROTECTION
- Malicious Activity Protection: Any individual deploying, executing, or attempting to deploy malware, automated price-scraping bots, malicious coding, or SQL injection attacks to alter pricing data, modify metadata tables, or gain unauthorized access to any page or back-end database of this Site will be aggressively prosecuted.
- Statutory Enforcement: Such actions constitute a criminal offense under the Cybercrimes Act 19 of 2020. OneStopMusic will actively cooperate with law enforcement and pursue maximum civil damages for any resulting loss, data corruption, or business disruption.
- You agree and guarantee that your personal account username and password are for your personal use only and will not be shared with any third party. You are solely responsible for actions taken using your account credentials.
- All credit card transactions on the Site are protected via Secure Socket Layer (SSL) encryption protocols managed by our banking gateway partners. OneStopMusic does not store or have access to confidential card numbers or raw payment data.
14. INDEMNITY & LIMITATION OF LIABILITY
- OneStopMusic is committed to fulfilling its obligations under the Consumer Protection Act 68 of 2008 and Articles 43(5) and 43(6) of the Electronic Communications and Transactions Act regarding secure payment systems.
- However, the Site and its technology infrastructure are provided strictly on an "as-is" and "as-available" operational basis. Neither OneStopMusic nor any of its directors, employees, or retail representatives will be held legally responsible or liable for any direct, indirect, incidental, or consequential financial loss, downtime, or accountability arising from the use of (or inability to use) this Site, its services, or its content.
- OneStopMusic provides no warranty, implied or otherwise, that the content or code attached to this website is completely free of errors or omissions, or that service will be 100% uninterrupted or faultless. We encourage users to report any system errors or malfunctions to info@onestopmusic.co.za.
- It is your responsibility, before accepting these T&Cs, to ensure that the service available through this website is compatible with your hardware or software specifications. Information, product descriptions, and opinions expressed on this Site must not be regarded as formal professional advice.
Applicable Law and Jurisdiction
This Site is controlled, managed, and run from the Republic of South Africa. As such, it is governed strictly by South African legislation. You and OneStopMusic submit to the non-exclusive jurisdiction of the South African courts. Each section of these terms must be read as individual and separable; if any clause is found invalid by a competent authority, the remainder of these T&Cs remains fully standing.
15. DATA PRIVACY & COMPLIANCE (POPIA)
OneStopMusic takes the security and processing of personal information seriously. By registering an account, concluding a purchase, or interacting with the website, you explicitly consent to the electronic collection, storage, and processing of your personal data (including names, physical addresses, emails, and phone numbers) in strict accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA"). We utilize this information solely for account administration, payment verification, logistical fulfillment, and internal consumer analytics as detailed in our comprehensive Privacy Policy page.
16. CHANGES TO TERMS AND CONDITIONS
OneStopMusic may, at its own sole discretion, change or update these terms and conditions or any part thereof at any time. If you are a registered Account Holder, OneStopMusic will inform you of major structural changes via email. It will be your responsibility to review the revised terms to ensure your continued satisfaction. If you are not a registered user, it is your responsibility to check these terms regularly. Continued use of the Site following updates constitutes explicit acceptance of the amended T&Cs.
17. DISPUTES & ARBITRATION
Save for urgent or interim interdictory relief that may be granted by a competent court of law: In the event of any irresolvable contractual disputes arising between you and OneStopMusic out of these terms and conditions, the dispute may be presented for confidential, expedited arbitration. Such arbitration will be handled in Pretoria or Johannesburg according to the expedited rules stipulated by the Arbitration Foundation of South Africa (AFSA). Alternatively, consumers retain their statutory right to escalate unresolved grievances to the Consumer Goods and Services Ombud (CGSO).
18. LEGAL NOTICE ADDRESS
OneStopMusic elects as its domicilium citandi et executandi (address for all purposes regarding legal notices or serving of court communication documents) the following address:

- Electronic Copy: An electronic copy must simultaneously be sent to info@onestopmusic.co.za for the serving of notice to be effected.
19. TERMINATION AND ACCESS RESTRICTION
These terms and conditions continue indeterminately for as long as the website exists. OneStopMusic is entitled to terminate these terms or shut down the website at any time, subject to processing any pending purchases that have already been dispatched. If you breach any obligations under these terms, OneStopMusic reserves the right to immediately block your IP address, terminate your user account, and deny you future access to the platform without prejudice to any civil damages the Company may claim.
20. COPYRIGHT AND INTELLECTUAL PROPERTY
All content, trademarks, logos, brand assets, and data on this website—including software, database paths, text, images, graphics, icons, designs, and agreements—are the exclusive property of or under explicit license to One Stop Music (Pty) Ltd. As such, they are protected by local and international intellectual property legislation and agreements. No part of this site may be scraped, copied, or reproduced without prior written consent.
21. ELECTRONIC COMMUNICATION
When you sign up for a OneStopMusic newsletter, opt into marketing materials, register an account, complete an online checkout, or send an email to our support team, you are communicating with us electronically and explicitly consent to receiving automated or manual operational electronic communications from OneStopMusic in return.
